How A Bill Becomes A Law
Step Actual Legislature Model Legislature
Drafting

Ideas come to Legislators from staff and Constituents. It is taken to Legislative Research Office who put it into proper form and language.

Participants come up with ideas and draft bills into form they wish to submit.

Submitting

Legislators take the bill and place it in the HOPPER of the house in which they are a member.

Bill sponsors must submit bills to Youth in Government office by March 1st.

Committee
Assignment

Clerks and the Presiding Officers of both houses recommend which committee should hear the bill. Both houses must  agree before bill is sent to committee.

The State YMCA Office assign all bills to committee.

Public Hearings

A date and location is announced and the hearing is held for each bill. Any person may voice an opinion at this hearing. Professional Lobbyist are most visible at these.

All bills receive a Public Hearing on Friday evening. All sponsors are to speak on their bills. Lobbyists this is your chance to shine and speak out on the bills.

Workshop

A workshop on the bill is held after the hearing. Again it is open to the public, but they are not involved unless asked by the committee. Bills are Amended and marked up at this time.

Workshops and markup on bills are heldaccording to the same rules. These are held Friday evening.

Reports

Committee meets in private to develop a committee report on bill.

(OTP) Ought to Pass

(ONTP) Ought not to Pass
Divided Reports, As Amended or Withdrawn by sponsor, To be resubmitted, are reports committee can give on bills.

Committees meet Friday evening to develop these reports same as Actual Legislature.

Bill Calendar

Leadership decide which bills will be heard in what order, in the House and Senate.

Bill Calendars will be set prior to the Augusta Sessions, listed in the Billbook, and in chambers. Governor's Chief of Staff will track bills to know they are. You Can suspend the rules with at 2/3 majority.

House / Senate
Floor Action

Each bill report is heard in both houses.

Both houses also give every bill two reading allowing time for every member two chances to speakand to vote on each bill.

Each bill's report is heard and every bill receives only ONE reading on each floor. Pay attention this is your only chance to talk on floor about the bill.

Conference
Committee

Both houses must agree to the exact form of the bill. Any differences may be worked out by a Conference committee made up of members from each house assigned by the Presiding officers

Both houses must agree on the exact form of the bill. Presiding Officers of each house select 3 members to represent the body in a Committee to work out differences. (Used only if time permits)

Engrossment

After passing in both houses a bill is engrossed, where all the additions/deletions are made.

Bill is put in final form and printed.

Time prohibits this part of process. Participants who wrote bills may pick up their copy after closing ceremony.

Final Action

After engrossment, both the Presiding officers must sign the bill.

Both presiding officers sign the bill after it passes both houses.

Governor's Action

The Governor has the following options:

a) Sign the bill

b) Veto the bill

c) Leave bill on desk for 10 legislative

    days and bill becomes law

d) Leave bill on desk for 10 days after

    adjournment, POCKET VETO

The same options except that Actual Governor has except, that any bill that has not been acted on by closing session on Sunday is considered to be "Pocket Vetoed"

Overriding Veto's

Veto's may be overridden by 2/3's majority of both houses.

Enactment

Bills are published in the State Statutes. After enactment date 90 days after the close of the legislature, or immediately if it is emergency legislation.

Sunday morning at closing session the action taken on each bill is reviewed.
